President Lula promulgates a law that toughens the fight against illegal betting

The President of Brazil, Luiz Inácio Lula da Silva, promulgated the Anti-Smaction Law on Tuesday, March 24.
The text provides for an increase in penalties for participating in a criminal or militia organization and facilitates the seizure of the property of those involved. In addition, there are passages that deal specifically with the fight against illegal betting.
The new legislation modifies Law 14.790/2023 (which regulated bets) and determines that financial and payment institutions block deposit, payment and other accounts registered in the name of irregular operators.
According to the law, payment institutions must also prevent the performance of new transactions that aim to enable, directly or indirectly, the irregular exploitation of the fixed-odded betting lottery.
The blockade must respect the due administrative process, with a guarantee of the right to be heard and the broad defense of the interested party, and will not prejudice the reimbursement of the amounts owed to the bettors. The responsibility for establishing the necessary procedures for the blockade will lie with the Central Bank and the Ministry of Finance, as provided for by law.
"Amounts held in the accounts blocked under this article that are declared lost in favor of the Union, including in terms of taxes, fines and other sanctions applied as a result of the irregular exploitation of the fixed-odded betting lottery, will have a destination linked to the National Public Security Fund," says a fragment of the legislation.
The National Public Security Fund, to which the text refers, is a mechanism of the Brazilian government created to finance public security actions throughout the country.
In addition, the text establishes that the Secretariat of Awards and Betting (SPA) of the Ministry of Finance must receive information on indications of electronic fraud in the sector. The SPA may maintain a public database with information on authorized operators, in order to feed and cross data with the fraud prevention systems used by the institutions.
"The institutions participating in Pix must implement mechanisms for detecting patterns suspected of use for unauthorized bets, based on criteria defined by the Central Bank of Brazil and by the Secretariat of Awards and Bets of the Ministry of Finance," the law maintains.
Another point is the responsibility of those who disseminate, disclose or monetize advertising content associated with illegal betting, provided that there is "unequivocal knowledge of the irregularity." This includes influencers and advertising or marketing companies, who can respond to administrative infraction and suffer other legal sanctions as the case may be.
"The characterization of the unequivocal knowledge referred to in paragraphs X and XII of the caput of this article may be given by formal notification, prior administrative decision, official publication or by elements that show the notoriety of the irregular condition of the promoted agent," the regulations establish.
